DEFINITIONS For purposes of these Terms, the following definitions shall apply: **Account** means the personal user profile created after successful registration and email verification. **Administrator** means any individual authorized by ApexChainExpert to manage, supervise, or administer the Platform. **Business Day** means any day excluding weekends and officially recognized public holidays where applicable. **Cryptocurrency** means any supported digital asset accepted by ApexChainExpert for deposits or withdrawals. **Deposit** means cryptocurrency transferred by a user into the Platform for investment or storage within the user's wallet. **Investment** means the allocation of cryptocurrency into an available investment plan offered through the Platform. **Investment Plan** means any investment package, program, or opportunity displayed on the Platform, including its investment amount, duration, and applicable return calculation. **KYC** means Know Your Customer verification procedures requiring users to submit identification documents or additional information. **Platform Wallet** means the internal cryptocurrency balance assigned to each registered user. **Returns** means the amount calculated in accordance with the selected investment plan upon successful completion of the investment term, subject to these Terms. **Withdrawal** means the transfer of cryptocurrency from the user's Platform wallet to an external cryptocurrency wallet approved by the user. --- # 2. ACCEPTANCE OF TERMS By creating an account or otherwise using ApexChainExpert, you represent and warrant that: * You are at least eighteen (18) years of age. * You possess the legal capacity to enter into binding agreements. * You are not prohibited from using online investment platforms under the laws applicable to your jurisdiction. * All information supplied during registration is true, accurate, complete, and current. * You agree to comply with these Terms, all applicable laws, regulations, and Platform policies. Continued use of the Platform constitutes ongoing acceptance of these Terms and any future amendments. --- # 3. ELIGIBILITY Use of ApexChainExpert is strictly limited to individuals who satisfy all eligibility requirements. You may not register or use the Platform if: * You are under eighteen (18) years of age. * You provide false or misleading information. * You are registering on behalf of another individual without proper authorization. * Your use violates any applicable law or regulation. * Your account has previously been suspended or terminated unless expressly reinstated by the Company. The Company reserves the right to request proof of eligibility at any time. --- # 4. ACCOUNT REGISTRATION To access investment services, users must complete the registration process by providing accurate information requested during account creation. Registration generally requires, among other information: * Full legal name; * Email address; * Password; * Country of residence; * Any additional information requested by the Platform. Users are solely responsible for ensuring that all submitted information remains accurate and current. Providing false information constitutes a material breach of these Terms. --- # 5. EMAIL VERIFICATION Every account must undergo email verification before access is granted. A verification link will be sent to the email address supplied during registration. Until verification is successfully completed: * Login access may be restricted. * Deposits may not be available. * Investment features may remain disabled. * Withdrawal functionality may remain unavailable. Failure to verify an email address within a reasonable period may result in automatic cancellation of the registration. --- # 6. ACCOUNT SECURITY Users are solely responsible for maintaining the confidentiality of their login credentials. ONE ACCOUNT PER USER Unless expressly authorized by the Company, each individual may maintain only one account. Creating or controlling multiple accounts may result in: * Immediate suspension; * Permanent account termination; * Cancellation of referral commissions; * Removal of bonuses; * Freezing of wallet balances pending investigation. The Company reserves absolute discretion in determining whether multiple accounts belong to the same individual. --- # 8. KNOW YOUR CUSTOMER (KYC) To comply with internal security standards and applicable regulatory obligations, ApexChainExpert reserves the right to require identity verification at any stage. Users may be required to submit: * Government-issued identification; * Passport; * Driver's licence; * National identity card; * Selfie verification; * Proof of address; * Additional documentation reasonably requested by the Company. Failure to complete KYC verification may result in restrictions including: * Withdrawal suspension; * Investment limitations; * Deposit limitations; * Temporary account restriction; * Permanent account closure where necessary. Submission of fraudulent documentation constitutes grounds for immediate termination. --- # 9. USER RESPONSIBILITIES Each user agrees to: * Provide truthful information. * Maintain updated account details. * Monitor investments responsibly. * Protect account credentials. * Comply with all Platform policies. * Use only cryptocurrency lawfully owned or controlled by the user. * Cooperate with verification requests. * Promptly report suspected security issues. Users acknowledge that misuse of the Platform may lead to disciplinary action, including permanent account closure. --- # 10. CRYPTOCURRENCY DEPOSITS ApexChainExpert accepts deposits exclusively in supported cryptocurrencies. The Company does not currently accept: * Cash; * Credit cards; * Debit cards; * Bank transfers; * Cheques; * Mobile money; * Any fiat currency. Users are solely responsible for ensuring deposits are sent: * To the correct wallet address; * Using the correct blockchain network; * In the correct cryptocurrency; * Within any applicable payment window. Cryptocurrency transactions recorded on the blockchain are generally irreversible. The Company shall not be liable for losses arising from deposits sent: * To incorrect wallet addresses; * Using unsupported blockchain networks; * In unsupported cryptocurrencies; * Without required transaction confirmations. Deposits shall normally be credited after sufficient blockchain confirmations have been received. --- # 11. INVESTMENT PLANS Users may invest available wallet balances into any eligible investment plan displayed on the Platform. Each investment plan specifies its applicable: * Minimum investment amount; * Maximum investment amount; * Duration; * Applicable return calculation; * Maturity period. By activating an investment, the user authorizes ApexChainExpert to allocate the invested cryptocurrency to the selected plan under its stated terms. Once an investment is successfully activated, it shall remain active until the applicable investment period expires, except where otherwise permitted under these Terms or required by law. Investment returns are calculated according to the selected investment plan and, upon successful completion of the investment term, are credited to the user's Platform wallet in accordance with the terms governing that plan. The Company reserves the right to modify, suspend, replace, or discontinue any investment plan without prior notice for operational, commercial, security, or legal reasons. Such modifications shall not generally affect investments that have already been activated unless necessary to comply with applicable law, regulatory requirements, security obligations, or circumstances beyond the Company's reasonable control. # 12. INVESTMENT MATURITY AND AUTOMATED WALLET CREDITING Each investment shall remain active for the duration specified by the selected investment plan. The Platform utilizes an automated investment management system designed to monitor investment durations and process matured investments. Upon successful completion of an investment term, and subject to these Terms, the Platform will ordinarily credit the user's Platform Wallet with: * The original invested capital; and * The applicable returns calculated under the selected investment plan. The maturity countdown displayed within a user's dashboard is provided for informational purposes only and may occasionally vary due to system synchronization, blockchain processing delays, scheduled maintenance, force majeure events, or other operational circumstances. A matured investment shall not be considered complete until the Platform has successfully processed and recorded the applicable wallet credit. The Company reserves the right to temporarily delay processing where reasonably necessary for: * Security verification; * Fraud investigations; * KYC compliance; * System maintenance; * Blockchain congestion; * Regulatory compliance; * Technical failures beyond the Company's reasonable control. Such delays shall not automatically constitute a breach of these Terms. --- # 13. PLATFORM WALLET Each registered user is assigned an internal Platform Wallet. The Platform Wallet is intended solely for the operation of services provided through ApexChainExpert and does not constitute a traditional bank account, payment account, custody account, or deposit account. Wallet balances may include: * Deposited cryptocurrency; * Matured investment proceeds; * Referral commissions; * Promotional bonuses; * Other credits approved by the Company. The Company reserves the right to correct any computational, accounting, display, or system errors affecting wallet balances. Incorrect credits resulting from software errors, administrative mistakes, duplicate transactions, or technical malfunctions remain the property of the Company and may be reversed without prior notice. --- # 14. WITHDRAWALS Users may request withdrawals of eligible cryptocurrency available within their Platform Wallet. Withdrawals may only be made to supported cryptocurrency wallet addresses. Before processing withdrawals, the Company may require additional verification including: * Identity verification; * KYC review; * Ownership confirmation of receiving wallets; * Security verification; * Email confirmation; * Additional authentication procedures. Withdrawal requests may be delayed, rejected, cancelled, or placed under review where: * Suspicious activity is detected; * Fraud is suspected; * KYC requirements remain incomplete; * Incorrect wallet information has been supplied; * Blockchain conditions significantly affect processing; * Legal or regulatory obligations require additional review. The Company shall not be responsible for cryptocurrency sent to wallet addresses incorrectly supplied by users. Users are solely responsible for confirming the accuracy of every withdrawal address before submitting a request. Once cryptocurrency has been successfully transmitted to the blockchain, the transaction generally cannot be reversed. --- # 15. PROCESSING TIMES Processing times displayed on the Platform are estimates only. Actual processing times may vary depending upon: * Blockchain confirmations; * Network congestion; * Wallet maintenance; * Internal compliance reviews; * Security verification; * Technical maintenance; * External service providers. The Company shall not be liable for reasonable processing delays beyond its direct control. --- # 16. FEES AND CHARGES Certain Platform services may be subject to administrative fees, blockchain network fees, processing charges, withdrawal charges, maintenance fees, or other applicable costs. Where applicable, such charges may be deducted from: * Deposits; * Withdrawals; * Wallet balances; * Investment proceeds. Blockchain network fees are determined independently by their respective blockchain networks and are outside the Company's control. The Company reserves the right to introduce, amend, remove, or revise fees at any time. Updated fee information may be published on the Platform before becoming effective. --- # 17. REFUND POLICY Cryptocurrency deposits remain under the control of the user until such time as they are committed to an active investment. A user may request a refund of available wallet funds provided that: * The deposited cryptocurrency has not been allocated to any active investment; * No fraud investigation is pending; * No legal restriction applies; * The account complies with these Terms. Approved refunds shall ordinarily be made to the originating cryptocurrency wallet whenever reasonably practicable. Once an investment has been successfully activated, the invested cryptocurrency shall generally no longer qualify for refund except where expressly required by applicable law or expressly approved by the Company. Blockchain network fees associated with refund transactions may be deducted where applicable. --- # 18. REFERRAL PROGRAM The Platform may operate an affiliate or referral program. Participation is voluntary. Referral rewards may be granted according to referral rules published by the Company from time to time. Referral commissions shall only be earned from legitimate referrals. Users shall not: * Refer themselves; * Create multiple accounts; * Use fake identities; * Use automated registrations; * Purchase referrals; * Manipulate referral statistics; * Participate in referral abuse schemes. The Company reserves the right to reverse, cancel, or recover referral rewards obtained through prohibited conduct. Referral programs may be modified, suspended, or discontinued at any time without prior notice. --- # 19. PROMOTIONS AND BONUSES From time to time, ApexChainExpert may offer promotional incentives including: * Deposit bonuses; * Referral bonuses; * Cashback promotions; * Loyalty rewards; * Limited-time campaigns. Participation in any promotion constitutes acceptance of the specific promotional rules applicable to that promotion. The Company reserves the right to withdraw, modify, suspend, or terminate promotional offers without liability. Bonuses obtained through fraud, abuse, technical exploitation, or violation of these Terms may be cancelled. --- # 20. PROHIBITED ACTIVITIES Users shall not directly or indirectly engage in any activity that may compromise the integrity, security, reputation, or operation of the Platform. Prohibited conduct includes, but is not limited to: * Fraud; * Identity theft; * Money laundering; * Terrorist financing; * Use of stolen cryptocurrency; * Multiple accounts; * Self-referrals; * False KYC submissions; * Impersonation; * Unauthorized access; * Attempted hacking; * Reverse engineering; * Malware distribution; * Automated account creation; * Spam; * Phishing; * Exploiting software vulnerabilities; * Market manipulation affecting Platform operations; * Circumventing security controls; * Uploading malicious code; * Interfering with Platform infrastructure; * Harassing employees or other users; * Using the Platform for unlawful purposes. Attempting any prohibited activity may result in immediate enforcement action regardless of whether actual harm occurs. --- # 21. FRAUD PREVENTION The Company maintains internal fraud detection systems designed to identify suspicious activity. The Company reserves the right to: * Monitor account activity; * Review transaction history; * Conduct identity verification; * Request additional documentation; * Delay processing; * Freeze transactions; * Restrict account functionality; * Suspend accounts pending investigation. Users agree to cooperate fully with legitimate fraud investigations. Failure to cooperate may result in permanent account closure. --- # 22. ANTI-MONEY LAUNDERING (AML) ApexChainExpert maintains internal procedures intended to discourage unlawful financial activity. The Company reserves the right to monitor transactions and investigate activity that appears inconsistent with normal Platform usage. Where reasonably necessary, the Company may request additional documentation concerning: * Source of funds; * Identity; * Transaction history; * Cryptocurrency ownership; * Wallet verification. Failure to provide requested information within a reasonable period may result in account restrictions. Nothing contained herein shall limit the Company's right to comply with applicable legal obligations or lawful requests from competent authorities. --- # 23. ACCOUNT SUSPENSION The Company reserves the right, without prior notice where reasonably necessary, to suspend any account where it reasonably believes that: * These Terms have been violated; * Fraud is suspected; * Identity verification is incomplete; * Security risks are identified; * Unauthorized access has occurred; * False information has been supplied; * Platform abuse is detected; * Applicable law requires restriction. During suspension, certain or all Platform functions may be unavailable, including: * Deposits; * Withdrawals; * Investments; * Referral participation; * Wallet access. Suspension shall remain in effect until the Company determines that the relevant issue has been satisfactorily resolved or until a final enforcement decision has been made. --- # 24. ACCOUNT TERMINATION The Company reserves the right to permanently terminate any account for material violations of these Terms. Grounds for termination include, without limitation: * Repeated violations of Platform policies; * Fraudulent conduct; * Criminal activity; * Submission of fraudulent documentation; * Abuse of investment services; * Referral fraud; * Unauthorized system access; * Activity reasonably considered harmful to the Platform or its users. Termination of an account shall not automatically extinguish any legal rights or obligations accrued prior to termination. The Company reserves the right to retain records relating to terminated accounts where required for security, compliance, legal, or operational purposes. # 25. INTELLECTUAL PROPERTY RIGHTS Unless otherwise expressly stated, all content available on ApexChainExpert, including but not limited to its name, logo, trademarks, trade dress, software, source code, databases, text, graphics, user interface designs, page layouts, icons, audio, video, documents, downloadable materials, and other proprietary content (collectively, the "Platform Content") is owned by or licensed to ApexChainExpert and is protected by applicable intellectual property and proprietary rights laws. Nothing contained within these Terms grants any ownership interest in the Platform Content. Users are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for its intended purposes and strictly in accordance with these Terms. Except with the Company's prior written consent, users shall not: * Copy; * Reproduce; * Modify; * Adapt; * Publish; * Distribute; * Sell; * Lease; * License; * Translate; * Decompile; * Reverse engineer; * Disassemble; * Create derivative works from; * Exploit commercially; * Remove copyright notices from; or * Otherwise misuse any portion of the Platform Content. Any unauthorized use may result in civil and criminal liability to the fullest extent permitted by law. --- # 26. USER CONTENT Where the Platform permits users to submit information, documents, feedback, reviews, communications, or other materials ("User Content"), users retain ownership of their lawful content. By submitting User Content, the user grants ApexChainExpert a worldwide, royalty-free, non-exclusive, transferable license to store, process, reproduce, display, and use such content solely for the operation, administration, security, legal compliance, improvement, and maintenance of the Platform. Users represent and warrant that any submitted content: * Is accurate; * Does not infringe third-party rights; * Is not unlawful; * Does not contain malicious software; * Does not contain defamatory, abusive, or fraudulent material. The Company reserves the right, but assumes no obligation, to remove User Content that violates these Terms or applicable law. --- # 27. ELECTRONIC COMMUNICATIONS By creating an account, users consent to receive electronic communications from ApexChainExpert. Such communications may include, without limitation: * Email verification messages; * Login notifications; * Security alerts; * Investment confirmations; * Deposit confirmations; * Withdrawal notifications; * KYC requests; * Administrative notices; * Service announcements; * Legal notices; * Policy updates; * Promotional communications, where permitted. Users acknowledge that electronic communications satisfy any legal requirement that such communications be provided in writing. Users remain responsible for maintaining an active and accessible email address. Failure to receive communications due to incorrect contact information, spam filtering, or inaccessible email accounts shall not relieve users of their obligations under these Terms. --- # 28. SERVICE AVAILABILITY The Company endeavors to maintain continuous access to the Platform. However, uninterrupted availability cannot be guaranteed. The Platform may occasionally become unavailable due to: * Scheduled maintenance; * Emergency maintenance; * Software upgrades; * Hardware failures; * Cybersecurity incidents; * Internet disruptions; * Blockchain outages; * Third-party service interruptions; * Force majeure events. The Company shall use commercially reasonable efforts to restore services as promptly as practicable but shall not be liable for temporary interruptions. --- # 29. SYSTEM MAINTENANCE To ensure security, performance, and operational stability, ApexChainExpert may periodically conduct maintenance affecting some or all Platform services. Maintenance may result in temporary limitations involving: * User login; * Deposits; * Withdrawals; * Investments; * Wallet balances; * Dashboard functionality; * Referral tracking. Whenever reasonably practicable, advance notice may be provided. Emergency maintenance may be performed without prior notice where necessary to protect users or the Platform. --- # 30. PRIVACY AND DATA PROTECTION The Company respects the privacy of its users and is committed to protecting personal information collected through the Platform. Information collected may include, without limitation: * Registration information; * Contact details; * Identity verification documents; * Transaction records; * Device information; * Login history; * IP addresses; * Security logs; * Blockchain transaction data. Such information may be collected, processed, stored, and used for purposes including: * Account administration; * Identity verification; * Fraud prevention; * Security monitoring; * Customer support; * Legal compliance; * Service improvement; * Internal analytics. The Company's handling of personal information is further described within its Privacy Policy, which forms an integral part of these Terms. --- # 31. THIRD-PARTY SERVICES The Platform may integrate or interact with third-party technologies, software providers, blockchain networks, analytics providers, communication services, cloud infrastructure, payment processors, security providers, or other external services. The Company does not control the availability, security, policies, or practices of independent third parties. Accordingly, ApexChainExpert shall not be responsible for losses arising solely from failures attributable to third-party services beyond the Company's reasonable control. Users acknowledge that blockchain networks operate independently of the Company. --- # 32. NO PROFESSIONAL OR FINANCIAL ADVICE Information made available through the Platform is provided for general informational and operational purposes only. Nothing contained on the Platform shall be construed as legal, tax, accounting, investment, financial, or other professional advice. Users remain solely responsible for obtaining independent professional advice appropriate to their individual circumstances before making financial decisions. Each user acknowledges that participation in any investment plan is undertaken voluntarily and at the user's own discretion. --- # 33. DISCLAIMER OF WARRANTIES Except to the extent prohibited by applicable law, the Platform and all services are provided on an "as available" and "as is" basis. The Company makes no representation or warranty, express or implied, regarding: * Continuous availability; * Error-free operation; * Compatibility with every device; * Freedom from viruses; * Freedom from cyberattacks; * Complete accuracy of displayed information; * Uninterrupted service; * Permanent availability of third-party services. Nothing contained in this section shall exclude any warranty that cannot lawfully be excluded under applicable law. --- # 34. LIMITATION OF LIABILITY To the fullest extent permitted by applicable law, ApexChainExpert, its owners, directors, officers, employees, administrators, contractors, representatives, licensors, affiliates, successors, and assigns shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or economic damages arising from or relating to: * Use of the Platform; * Inability to access the Platform; * Blockchain delays; * Network congestion; * Unauthorized account access; * User negligence; * Cybersecurity incidents beyond reasonable control; * Third-party services; * Data transmission failures; * Force majeure events; * Technical interruptions. Nothing contained herein shall exclude liability where such exclusion is prohibited by applicable law. --- # 35. USER INDEMNIFICATION Users agree to indemnify, defend, and hold harmless ApexChainExpert, its affiliates, administrators, officers, employees, contractors, successors, and representatives from and against any claims, actions, liabilities, damages, judgments, costs, expenses, or reasonable legal fees arising from or relating to: * Violation of these Terms; * Fraudulent conduct; * Misuse of the Platform; * Breach of applicable law; * Infringement of third-party rights; * Submission of false information; * Unauthorized use of another person's identity; * User negligence. This indemnification obligation shall survive termination of these Terms. --- # 36. FORCE MAJEURE The Company shall not be liable for any delay, interruption, suspension, or failure in performance resulting from circumstances beyond its reasonable control. Such circumstances include, without limitation: * Natural disasters; * Floods; * Earthquakes; * Fires; * Pandemics; * Epidemics; * Civil unrest; * War; * Terrorist acts; * Government actions; * Internet failures; * Power outages; * Blockchain disruptions; * Cybersecurity incidents; * Labour disputes; * Communication failures; * Acts of God. The Company shall resume performance as soon as reasonably practicable following the cessation of the relevant event. --- # 37. USER COMPLAINTS AND DISPUTE RESOLUTION ApexChainExpert is committed to resolving user concerns fairly, professionally, and efficiently. Users are encouraged to first submit disputes, complaints, or service concerns through the Platform's official support and dispute resolution system. Users agree to provide: * A detailed description of the issue; * Relevant transaction information; * Supporting documentation where applicable; * Any additional information reasonably requested during investigation. The Company will review complaints in good faith and endeavor to provide a timely response. Nothing in this section prevents either party from pursuing any legal rights available under applicable law after reasonable efforts have been made to resolve disputes through the Platform's internal dispute resolution procedures. --- # 38. CHANGES TO THE PLATFORM The Company reserves the right, at any time and without prior notice where reasonably necessary, to: * Modify Platform functionality; * Introduce new services; * Suspend services; * Remove services; * Replace investment plans; * Improve security measures; * Update operational procedures; * Change user interface features. Continued use of the Platform following such changes constitutes acceptance of those modifications. --- # 39. AMENDMENTS TO THESE TERMS ApexChainExpert reserves the right to amend, revise, supplement, or replace these Terms at any time. Where practicable, updated Terms will be published on the Platform together with a revised "Last Updated" date. Users are encouraged to review these Terms periodically. Continued use of the Platform after revised Terms become effective constitutes acceptance of those revisions. --- # 40. SEVERABILITY If any provision of these Terms is determined by a court or other competent authority to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be interpreted, modified, or replaced to the minimum extent necessary to achieve its intended commercial purpose while preserving the enforceability of the remaining Terms. --- # 41. ENTIRE AGREEMENT These Terms, together with the Privacy Policy, AML & KYC Policy, Refund Policy, Risk Disclosure, Cookie Policy, Disclaimer, and any other policies expressly incorporated by reference, constitute the entire agreement between the user and ApexChainExpert regarding use of the Platform. These Terms supersede all previous communications, representations, understandings, or agreements relating to the Platform, whether oral or written. --- # 42. GOVERNING LAW These Terms shall be governed by and interpreted in accordance with the laws of the jurisdiction in which ApexChainExpert is legally established, without regard to conflict of law principles. Any legal proceedings arising from or relating to these Terms shall be brought before the courts or other competent tribunals having jurisdiction in accordance with applicable law, unless otherwise required by mandatory legal provisions. --- # 43. CONTACT INFORMATION Questions regarding these Terms or any aspect of the Platform may be submitted through the official customer support channels made available on ApexChainExpert. Official communications should be directed only through contact information published on the Platform. Users are encouraged to report security concerns, suspected fraud, unauthorized account activity, or legal notices promptly using the appropriate support channels. --- By accessing, registering for, depositing cryptocurrency into, investing through, or otherwise using ApexChainExpert, you acknowledge that you have carefully read these Terms and Conditions, understand them, and agree to be legally bound by them in their entirety.
